Introduction and scope

This Privacy Policy explains how FORMLESS, INC. (“we”, “us”, “our”) collects, uses, shares, and protects information in connection with HowMuchIsMyClaim.com and any related pages, forms, or tools we operate (the “Site”).

We are not a law firm. We are a free service that helps people understand whether they may have a legal claim and connects them with third-party attorneys and legal marketing partners. Understanding that business model is important to understanding this policy, because sharing your information with those third parties is the core of what we do. We have tried to be direct about that throughout.

This policy covers information we collect through the Site. It does not cover the practices of any attorney, law firm, or partner you are connected with — once your information reaches them, their own privacy policy governs what they do with it.

Information we collect

Information you give us

• Contact details — your name, email address, phone number, and postal or ZIP code
• Your message — anything you type into our contact form
• Case-related details — where our qualification tools ask about your situation, the answers you give. This can include information about an injury, an accident, medical treatment, employment, and dates. Some of this may be sensitive.
• Privacy request details — if you exercise a privacy right, the information needed to identify you and process the request

You choose what to submit. If you would rather not share something, you do not have to — though we may not be able to help you if we do not have enough to work with.

Information collected automatically

• Device and connection data — IP address, browser type and version, operating system, device type, and screen size
• Usage data — the pages you view, the links you click, how long you stay, and the page or advert that sent you to us
• Cookies and similar technologies — see the Cookies and tracking section below
• Consent capture data — where we use consent verification services such as TrustedForm or Jornaya/LeadiD, a record documenting the consent you gave, including a session recording of the form interaction, a timestamp, and the page you were on

Information from third parties

We may receive information about you from advertising platforms, analytics providers, marketing partners who referred you to us, and publicly available or commercially available sources. Where we do, we handle it under this policy.

How we use information

We use information to:

• Assess, in general terms, whether your situation may give rise to a claim
• Connect you with attorneys, law firms, attorney networks, and legal marketing partners
• Contact you about your potential claim, by phone, text, or email
• Respond to your questions and requests
• Operate, maintain, secure, and improve the Site
• Measure and improve our advertising, including on platforms such as Meta and Google
• Detect and prevent fraud, spam, and abuse
• Document consent for compliance purposes, including under the Telephone Consumer Protection Act
• Comply with law and enforce our Terms of Service

How we share information

This section matters more than any other on this page. Please read it.

When you submit your information through the Site, we share it with third parties who pay us for it, so that they can contact you about your potential claim. Under California law, and the law of several other states, this is treated as a “sale” or “sharing” of personal information. We are telling you that plainly rather than burying it.

Categories of recipients:

• Law firms and attorneys in our network, who may evaluate and contact you about your potential claim
• Attorney networks and legal marketing partners, who may pass your information to attorneys in their own networks
• Advertising and analytics providers, such as Google and Meta, in connection with measuring and targeting advertising
• Consent verification providers, such as TrustedForm or Jornaya, which document the consent you gave
• Service providers who host, secure, or support the Site on our behalf, under contract
• Legal and safety recipients — where we are required to disclose by law, subpoena, or legal process, or where disclosure is necessary to protect rights, safety, or property
• A successor entity, in connection with a merger, acquisition, financing, or sale of assets

We may share your information with more than one attorney or partner. That means you may be contacted by several parties about a single submission.

What each recipient does with your information afterwards is governed by their own privacy policy, not this one. We do not control their retention, use, or onward sharing.

We do not knowingly sell or share the personal information of anyone under 16.

Marketing communications and TCPA

Where you provide a phone number and give consent, you may receive calls and text messages from us, our affiliates, and attorneys and partners in our network. These may use automated dialing technology and artificial, pre-recorded, or AI-generated voice.

Consent to be contacted is not a condition of any purchase and does not obligate you to hire any attorney.

To stop receiving communications:

• Text messages — reply STOP to any message. Reply HELP for help. Message and data rates may apply.
• Email — use the unsubscribe link in any marketing email.
• Calls — tell the caller you wish to be removed, or contact us at privacy@howmuchismyclaim.com.

Opting out with us stops our communications. If a third-party attorney or partner already has your information, you will need to opt out with them directly as well. We will help where we can.

Cookies and tracking technologies

We use cookies and similar technologies to run the Site, remember your preferences, understand how the Site is used, and measure advertising.

Technologies we use or intend to use:

• Strictly necessary cookies — required for the Site to function
• Analytics — such as Google Analytics 4, to understand aggregate usage
• Advertising pixels — such as the Meta Pixel, to measure and target advertising
• Consent capture — such as TrustedForm or Jornaya, which record the consent interaction on our forms

You can control cookies through your browser settings, and most browsers let you block or delete them. Blocking some cookies will affect how the Site works. You can also opt out of certain advertising through the platforms themselves and through industry tools such as the Digital Advertising Alliance’s opt-out page.

Your privacy rights

California residents (CCPA/CPRA)

If you are a California resident, you have the right to:

• Know and access — request the categories and specific pieces of personal information we have collected about you, where it came from, why we collected it, and who we disclosed it to
• Delete — request deletion of personal information we hold about you, subject to exceptions
• Correct — request correction of inaccurate personal information
• Opt out of sale or sharing — direct us to stop selling or sharing your personal information. Given how our service works, this right is particularly relevant here. Use our Do Not Sell or Share My Personal Information page.
• Limit use of sensitive personal information — where applicable
• Non-discrimination — we will not deny you service, charge you a different price, or provide a different level of quality because you exercised a privacy right

Residents of other states

Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws have comparable rights, which generally include access, correction, deletion, portability, and the right to opt out of targeted advertising, the sale of personal data, and certain profiling. Several of these states also provide a right to appeal a refused request. Where your state gives you a right, we will honour it.

How to make a request

Tell us what you are requesting and give us enough information to find your records — typically the name, email address, and phone number you used with the Site. We will verify your identity before acting on a request, and we may ask for additional information to do so. We will respond within the timeframe your state’s law requires.

An authorised agent may make a request on your behalf with written permission, which we may ask to see.

Data retention

We keep personal information for as long as needed for the purposes described in this policy, and afterwards for as long as we have a legal, regulatory, or legitimate business reason to do so.

In practice, consent records are typically retained longer than other data, because TCPA compliance requires us to be able to demonstrate the consent that was given. Retention periods vary by data type.

When information is no longer needed, we delete or de-identify it.

Data security

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit via HTTPS across the entire Site.

No method of transmitting or storing information is completely secure, and we cannot guarantee absolute security. Please do not send us sensitive information by unencrypted email.

Children’s privacy

The Site is intended for adults. It is not directed at children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has given us personal information, contact privacy@howmuchismyclaim.com and we will delete it.

Third-party links

The Site links to websites we do not operate. We are not responsible for their content or privacy practices. Read the privacy policy of any site you visit.

Users outside the United States, and Do Not Track

The Site is intended for use in the United States, and information we collect is processed there. If you access the Site from outside the US, you understand that your information will be transferred to and processed in the US, where privacy laws may differ from those where you live.

Browsers send a “Do Not Track” signal that has no agreed standard, and we do not currently respond to it. We do honour recognised opt-out preference signals, such as Global Privacy Control, where required by law.

Changes to this policy

We may update this policy. When we do, we will change the “Last updated” date at the top of this page. Material changes will be signposted on the Site where practicable. Please check back periodically.
